## What is an excess soil hauling record?

The record that has to be with the driver, on paper or on screen, for every load of excess soil moved in Ontario under O. Reg. 406/19. The hauler must not leave a site with excess soil without it. The loading site owner or operator makes sure it is created and confirms it is accurate; the person at the deposit site acknowledges the deposit in it.

The regulation does not set a form, only what the record must hold, so any format with every item works. A new record is needed for each load.

## O. Reg. 406/19 hauling record requirements

Before leaving: where and when the soil was loaded, how much is in the load, whether it includes salt-impacted or asphalt-impacted soil, a contact at the loading site (name, telephone and email), the hauling firm, the driver’s name and the vehicle’s number plates, where the load is going, and a contact at the deposit site.

On arrival: the date and time it was deposited, and the name, telephone number and declaration of the individual at the deposit site who acknowledges the deposit. Arrange in advance for someone to be there to do it.

One truck collecting from several project areas, as in daylighting work, lists every area in one record, with the date, time and quantity loaded at each.

## When no hauling record is needed

No record is needed when the total dry excess soil removed from a project area is 5 m³ or less, when the total dry excess soil taken to and finally placed at a reuse site for one undertaking is 5 m³ or less, or when the soil is packaged as a landscaping or gardening product. The driver must still be able to give the same information to a provincial officer who asks.

The regulation does not cover hazardous waste, hauled sewage or asbestos waste; those follow Regulation 347.

### Can the hauling record be electronic?

### What if the deposit site turns the load away?

The loading site must already have confirmed a fallback with the hauler: an alternate site approved to take the soil, or a return to the loading site. Soil refused for its quality goes back to where it was loaded or to a suitable waste disposal site, never to an unplanned site. Whichever site takes it is written on the record as the deposit location and acknowledges receipt. ### Who keeps the hauling record, and for how long?

The hauler and everyone responsible for the soil, including the project leader, the loading site and the deposit site, keep a copy of each completed record for at least 2 years from the day the soil was loaded. ### Is this the same as the Excess Soil Registry?

No. Some projects must also register in RPRA’s Excess Soil Registry and run a tracking system to confirm each load reached the agreed deposit site. A hauling record can be part of that tracking system; it does not replace the registry filing.
