## What is a Part 360 waste tracking document?

The NYSDEC waste tracking document for C&D debris goes with each covered load from the site where it was picked up to the receiving facility. The generator describes the debris, the quantity and where it is going and signs; the driver signs on collection; the receiving site signs on delivery.

It has to be on DEC’s own form or a version DEC has approved. The July 2023 form is DEC’s current one for C&D debris.

## Which loads need a waste tracking document

Under 6 NYCRR 364-5.1, registered and permitted transporters need one for Fill Types 1 to 3 moved within the New York City Metropolitan Area Waste Impact Zone, Fill Types 4 and 5 anywhere in the state, and excavated material that does not meet the reuse rules in 360.12 or 360.13. Transporters of any C&D debris generated in the Zone need one too. The Zone is New York City and Nassau, Suffolk, Putnam and Westchester counties.

Ordinary C&D debris generated elsewhere in the state is not covered by 364-5.1. Loads of 10 cubic yards or less with no other regulated waste mixed in are exempt from Part 364, and so are concrete, asphalt, brick and rock moved outside the Zone.

In New York City, state law (ECL 27-3101) goes further: generators must give the transporter a signed tracking document for every C&D shipment, with no size limit.

## How to fill out the C&D debris tracking document

The generator, or their authorized representative, ticks the type of debris, enters the quantity in tons or cubic yards (and ticks the box if it is estimated), gives the pickup location, the generator’s details, the transporter and the receiving facility, then signs and dates the certification before the transporter accepts the load.

The driver enters the transporter’s DEC permit or registration number, the company, any discrepancy in type or quantity, their name, phone and plate number, and signs. On delivery, the receiving site enters its details, marks whether it is an interim processor or the final site, notes any discrepancy and signs.

## Who returns the tracking document, and when

The transporter gives the receiving site a copy on delivery and returns the completed document to the generator within 15 days. For Fill Types 4 and 5, contaminated excavated material and all C&D debris generated in the Zone, the transporter also sends a copy to NYS DEC within 15 days: by email to transport@dec.ny.gov, fax to 518-402-9034, or post to 625 Broadway, 9th Floor, Albany, NY 12233-7251.

A transporter must not accept a load that does not match the type or quantity on the document. Any discrepancy is reported to DEC within 15 days of receiving the waste, with what was done to reconcile it.

### Does every load of C&D debris in New York need a tracking document?

No. It covers C&D debris generated in New York City, Nassau, Suffolk, Putnam and Westchester, Fill Types 4 and 5 anywhere, Fill Types 1 to 3 moved within that area, and excavated material that cannot be reused. ### My load is under 10 cubic yards. Do I still need one?

### Can I use our own delivery ticket instead?

### What if I don’t know the exact quantity?

### How long do transporters keep tracking documents?
