## Is D009 hazardous waste?

**Yes.** Waste is D009 when the TCLP extract of a representative sample holds mercury at or above 0.2 mg/L. That makes it toxic hazardous waste, whatever industry or process it came from.

Compare the mercury in the TCLP extract with 0.2 mg/L. A total mercury result is a different measure, so it can't be compared with this limit.

D009 is a nonacute characteristic. On a required [hazardous waste manifest](https://complyonsite.com/tools/hazardous-waste-manifest), put D009 in Item 13. See [VSQG exemptions and empty-container rules](https://complyonsite.com/tools/rcra-waste-codes?list=routes).

## What does D009 cover?

D009 applies when a representative sample gives a TCLP extract with mercury at or above 0.2 mg/L. The limit is for the extract, not the waste’s total mercury.

- **CAS**: 7439-97-6
- **Regulatory level**: 0.2 mg/L in TCLP extract
- **Hazard**: T, toxic
- **Rule**: [40 CFR 261.24](https://www.ecfr.gov/current/title-40/chapter-I/subchapter-I/part-261/section-261.24)

## Is mercury waste always D009?

| Code | When it fits |
| --- | --- |
| D009 | The TCLP extract of a representative sample holds mercury at or above 0.2 mg/L. |
| [D004–D043](https://complyonsite.com/tools/rcra-waste-codes?list=toxicity) | The mercury result is below 0.2 mg/L, but another contaminant or characteristic can still apply. |
| [U151](https://complyonsite.com/tools/rcra-waste-codes?code=u151) | Unused mercury is thrown away pure, as technical grade, or as the product’s only active ingredient. |

Generators decide the codes from testing or knowledge of the waste, under 40 CFR 262.11. A result below 0.2 mg/L rules out D009 only. It doesn't make the waste nonhazardous.
