## Is D040 hazardous waste?

**Yes.** D040 is hazardous waste when the TCLP extract of a representative sample holds trichloroethylene at 0.5 mg/L or more. That makes it toxic hazardous waste, whatever industry or process it came from.

Compare the trichloroethylene in the TCLP extract with 0.5 mg/L. A total trichloroethylene result is a different measure, so it can't be compared with this limit.

D040 is a nonacute characteristic. On a required [hazardous waste manifest](https://complyonsite.com/tools/hazardous-waste-manifest), put D040 in Item 13. See [VSQG exemptions and empty-container rules](https://complyonsite.com/tools/rcra-waste-codes?list=routes).

## What does D040 cover?

D040 applies when the TCLP extract of a representative waste sample holds trichloroethylene at 0.5 mg/L or more. The limit is for the extract, not the waste’s total trichloroethylene.

- **CAS**: 79-01-6
- **Regulatory level**: 0.5 mg/L in TCLP extract
- **Hazard**: T, toxic
- **Rule**: [40 CFR 261.24](https://www.ecfr.gov/current/title-40/chapter-I/subchapter-I/part-261/section-261.24)

## Is trichloroethylene waste always D040?

| Code | When it fits |
| --- | --- |
| D040 | A representative sample’s TCLP extract contains trichloroethylene at or above 0.5 mg/L. |
| [D004–D043](https://complyonsite.com/tools/rcra-waste-codes?list=toxicity) | The trichloroethylene result is below 0.5 mg/L. Another contaminant or characteristic may still apply. |
| [U228](https://complyonsite.com/tools/rcra-waste-codes?code=u228) | Unused trichloroethylene is discarded pure, technical grade, or as the product’s sole active ingredient. |

Generators decide the codes from testing or knowledge of the waste, under 40 CFR 262.11. A result below 0.5 mg/L rules out D040 only. It doesn't make the waste nonhazardous.

## Which wastes take D040?

| Waste | When it’s D040 |
| --- | --- |
| [Contaminated soil](https://complyonsite.com/tools/rcra-waste-codes?waste=contaminated-soil) | Trichloroethylene leaching from contaminated soil reaches the TCLP limit |
| Vehicle wash wastewater | Trichloroethylene leaching from vehicle wash wastewater reaches the TCLP limit |
| [Parts washer solvent](https://complyonsite.com/tools/rcra-waste-codes?waste=parts-washer-solvent) | Trichloroethylene leaching from parts washer solvent reaches the TCLP limit |
| [Solvent-contaminated wipes](https://complyonsite.com/tools/rcra-waste-codes?waste=solvent-wipes) | Trichloroethylene leaching from solvent-contaminated wipes reaches the TCLP limit |
