## Is F039 hazardous waste?

**Yes.** F039 is a nonacute F-listed hazardous waste when the named source process and waste stream match. The federal table gives it hazard code T for toxicity.

F039 is listed by source, so how and where the waste arose decides it, not a concentration test alone. A test can add a characteristic code but doesn't remove the listing once its conditions are met. On a required [hazardous waste manifest](https://complyonsite.com/tools/hazardous-waste-manifest), put F039 in Item 13. Look up the [VSQG exemptions and empty-container rules](https://complyonsite.com/tools/rcra-waste-codes?list=routes) too.

## What does F039 cover?

Leachate that has passed through more than one land-disposed restricted waste listed as hazardous under RCRA Subpart D. Leachate from only F020, F021, F022, F026, F027 and F028 wastes, and no other hazardous waste, keeps those codes and is not F039.

- **Hazard code**: T for toxicity
- **Rule**: [40 CFR 261.31](https://www.ecfr.gov/current/title-40/chapter-I/subchapter-I/part-261/subpart-D/section-261.31)

## Is leachate from several restricted wastes F039 or another code?

| Code | When it fits |
| --- | --- |
| F039 | Leachate passes through multiple land-disposed restricted listed wastes, outside the F020/F021/F022/F026/F027/F028-only exception. |
| [Original F020/F021/F022/F026/F027/F028 codes](https://complyonsite.com/tools/rcra-waste-codes?list=f-listed) | Leachate derives from one or more of F020, F021, F022, F026, F027 and F028, and no other hazardous waste. |
| Original listed waste code | The leachate comes from 1 listed waste. Its status follows that source listing and the derived-from rule. |

Leachate from several of the 6 named wastes is still not F039 if no other hazardous waste is involved. For any other mix, find the land-disposed restricted source wastes and use the multi-source listing. A characteristic can also apply. Source history decides, not chemical content alone.

## Which wastes take F039?

| Waste | When it’s F039 |
| --- | --- |
| Leachate from listed hazardous waste | Leachate from the disposal of more than one restricted waste under the F039 listing |
