What changes in New Mexico?
Current 20.4.1 NMAC incorporates the federal hazardous-waste identification rules, and no effective New Mexico code list was found. New Mexico has added firefighting foam made with PFAS on purpose to its statutory hazardous-waste definition. As of the survey date, NMED calls the waste codes and management standards proposed rulemaking, not an effective code system.
How do I choose New Mexico codes?
Apply the current federal identification rules and the state's statutory foam definition. Proposed rules don't give an effective code list.
What do I record in New Mexico?
On a required manifest, enter the federal codes in Item 13. No extra New Mexico waste code is confirmed.
