Chlorobenzilate — an insecticide used against mites

U-list unused product.

U-listed hazardous waste for unused chlorobenzilate, a pesticide once used against mites on fruit trees.

Is U038 hazardous waste?

Yes, when the listing applies. U038 covers the unused chlorobenzilate described below when it is discarded, including off-specification product and qualifying residues. It is a U-listed waste, not an acute P-listed one. The listing depends on the product and how it is discarded, not on a TCLP result alone.

U038 is nonacute hazardous waste. On a required hazardous waste manifest, put U038 in Item 13. See VSQG exemptions and empty-container rules and pharmaceutical containers.

What does U038 cover?

This covers unused chlorobenzilate discarded in pure or technical grade, or in a formulation where it is the only active ingredient. It also covers off-specification batches, residues in nonempty containers and spill cleanup residues from those products. Inactive ingredients don't stop chlorobenzilate counting as the sole active ingredient.

Is chlorobenzilate waste always U038?

CodeWhen it fits
U038The unused chemical is discarded as a pure or technical grade product or as the sole active ingredient. Residues from that product also count.
Characteristic waste (D001–D043)A used chemical or a different formulation meets a hazardous-waste characteristic. Check any process listings that apply too.

Both can apply, since a listed unused product can also show a characteristic. Having this chemical in a manufacturing waste doesn't make the waste U038. Match the waste's origin, formulation and use history. Mixing listed waste with solid waste, or treating it, doesn't normally remove the listing. Only an exclusion, an exception or an approved delisting does.
