A waste transfer note made on this page, filled in for one skip and signed by both people

What is a waste transfer note?

The duty of care record that goes with waste whenever a business hands it to someone else. Both people sign it and both keep a copy.

The law sets what it must say, not how it looks:

  1. The List of Waste (EWC) code and a description of the waste
  2. How much, and whether it is loose or in a container
  3. Where and when it changed hands
  4. The SIC code of whoever hands it over
  5. Both names, addresses and signatures
  6. What each of them is, such as producer or carrier, and any permit or registration number
  7. A statement that the waste hierarchy was applied

Environmental Protection Act 1990, section 34, regulation 35 of the Waste (England and Wales) Regulations 2011, GOV.UK

How to fill in a waste transfer note

One for each load your business hands to someone else, a skip firm included. Not for waste from your own home, waste moved between your own sites, or hazardous waste, which takes a consignment note (code of practice).

EWC code
The code that fits the load. A code with an asterisk is hazardous and can’t go on this note. Where building waste has a pair, such as 17 09 04 and 17 09 03*, and you can’t find out what’s in it, it takes the one with the asterisk. Find a code
SIC code
Of whoever hands the waste over, such as 43110 for demolition. A company’s code is on its Companies House record.
Carrier
Look up their registration with the Environment Agency, Natural Resources Wales or SEPA. Most firms carrying other people’s waste need upper tier, numbers starting CBDU. A builder carrying their own building waste does too (regulation 24(5)).
Signatures
Both of you, on paper or on screen. An electronic note takes an electronic signature (regulation 35).

Can I use an annual waste transfer note?

Yes, for the same waste going with the same carrier. An annual note, or season ticket, lasts up to a year, lists each collection and is kept for 2 years after the last one. The note above is for a single load.

Does digital waste tracking replace transfer notes?

No. From October 2026 most permitted sites in England and Wales that receive waste also record it on the digital waste tracking service (who it covers). The rules for transfer notes have not changed.

At Sign, this page fills in Defra’s Receipt of Waste spreadsheet for the load, ready for the site to finish and upload.

Questions people ask

How long do you keep waste transfer notes?

At least 2 years, both of you, on paper or on a phone or computer. If the council, the Environment Agency or Natural Resources Wales asks to see one, you have 7 days to produce it. Hazardous waste consignment notes are kept for 3 years by the producer and consignor. Regulation 35

What happens if you don’t have one?

Breaking the duty of care is an offence, and the fine has no upper limit. If you can’t produce a note when asked, the council, the Environment Agency or Natural Resources Wales can offer a £300 fixed penalty instead of prosecution. Environmental Protection Act 1990, section 34A

Does this work in Scotland or Northern Ireland?

Yes. Choose the place beside the steps and the note follows its rules. Your answers stay when you change the place. NetRegs duty of care guidance

Does ComplyOnSite keep my note?

No. Your notes stay in this browser on this device, and only you save or send the PDF. A Companies House search sends the letters you type through our server to Companies House, and the answer is kept for a day. If someone signs on their own phone, the note is locked on your phone first, so our server holds a copy it can’t read, for 7 days. The page checks that every item is filled in, not that it’s right. The note records what the two of you state and sign.
