  • F-listed waste

Leachate from more than one restricted listed hazardous waste

F-list process waste.

Brown liquid in a sample bottle, drawn for RCRA waste code F039, multi-source restricted-waste leachate. Landfill leachate from several restricted wastes.
Toxic F-listed waste. Leachate from disposing of more than one restricted waste in a landfill, in place of the single codes.

Is F039 hazardous waste?

Yes. F039 is a nonacute F-listed hazardous waste when the named source process and waste stream match. The federal table gives it hazard code T for toxicity.

F039 is listed by source, so how and where the waste arose decides it, not a concentration test alone. A test can add a characteristic code but doesn't remove the listing once its conditions are met. On a required hazardous waste manifest, put F039 in Item 13. Look up the VSQG exemptions and empty-container rules too.

What does F039 cover?

Leachate that has passed through more than one land-disposed restricted waste listed as hazardous under RCRA Subpart D. Leachate from only F020, F021, F022, F026, F027 and F028 wastes, and no other hazardous waste, keeps those codes and is not F039.

Is leachate from several restricted wastes F039 or another code?

CodeWhen it fits
F039Leachate passes through multiple land-disposed restricted listed wastes, outside the F020/F021/F022/F026/F027/F028-only exception.
Original F020/F021/F022/F026/F027/F028 codesLeachate derives from one or more of F020, F021, F022, F026, F027 and F028, and no other hazardous waste.
Original listed waste codeThe leachate comes from 1 listed waste. Its status follows that source listing and the derived-from rule.

Leachate from several of the 6 named wastes is still not F039 if no other hazardous waste is involved. For any other mix, find the land-disposed restricted source wastes and use the multi-source listing. A characteristic can also apply. Source history decides, not chemical content alone.
