F037, Primary oil, water and solids separator sludge from a refinery.
F-listed waste
Primary oil, water and solids separator sludge from a refinery
F-list process waste.
Is F037 hazardous waste?
Yes. F037 is a nonacute F-listed hazardous waste when the named source process and waste stream match. The federal table gives it hazard code T for toxicity.
F037 is listed by source, so how and where the waste arose decides it, not a concentration test alone. A test can add a characteristic code but doesn't remove the listing once its conditions are met. On a required hazardous waste manifest, put F037 in Item 13. Look up the VSQG exemptions and empty-container rules too.
What does F037 cover?
Primary sludge from gravity separation of oil, water and solids in petroleum refinery process wastewater or oily cooling water. It includes sludge from separators, tanks, impoundments, conveyances, sumps and stormwater units that receive dry-weather flow. It excludes the stormwater, segregated cooling-water, aggressive biological treatment and K051 sludges named in the official listing. The 261.4(a)(12)(i) recycling exclusion needs the material to go back into refining with no land placement first and no speculative accumulation. Thermal cracking also needs nonhazardous coke.

Is primary refinery separator sludge F037 or F038?
| Code | When it fits |
|---|---|
| F037 | Primary sludge from gravity separation of oil, water and solids in petroleum-refinery process wastewater or oily cooling water. |
| F038 | Sludge or float from physical or chemical separation of oil, water and solids in petroleum-refinery process wastewater or oily cooling water. |
The operation and waste form pick the listing, not the chemical content alone. The rows show nearby listed streams, not every code that could apply. Add any characteristic or other listing that also fits, since one waste can carry more than 1 federal code.
When does a recycling residual become F037?
A residual from processing or recycling refinery material that 261.4(a)(12)(i) excludes becomes F037 once it is disposed of or meant for disposal, if the original material would have met a Subpart D listing.
Which codes sit beside F037?
| Code | What it is |
|---|---|
| F025 | Filters, drying agents and light residues from chlorinated hydrocarbons |
| F026 | Waste from equipment formerly used with alkaline chlorobenzenes |
| F027 | Unused chlorophenol formulations |
| F028 | Residue from heat-treating soil contaminated with listed dioxin waste |
| F032 | Waste from wood preserving with chlorophenol products |
| F034 | Waste from wood preserving with creosote |
| F035 | Waste from wood preserving with arsenic or chromium |
| F039 | Leachate from more than one restricted listed hazardous waste |
