What decides an empty container's class in Texas?
First confirm the container is legally empty.
A container defaults to Class 1 if it held a hazardous substance, hazardous waste or Class 1 waste.
The same default applies if its contents would be hazardous or Class 1 when discarded.
A container of 5 gallons or less can be Class 2.
For a larger container, remove all residue and make the container unusable.
The documented recycling route also needs complete residue removal and recycling that makes the container unusable.
That route doesn't cover a pesticide container regulated by the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA).
A container that held Class 2 waste stays Class 2.
What belongs on a separate Texas container stream?
Record the former contents and why the container is legally empty.
Classify any remaining product or residue separately.
For pressure and residue conditions, see depleted aerosol cans.
For the paperwork, see Code, class and shipment records.
