What changes the class of contaminated soil in Texas?

First rule out hazardous waste.

Petroleum-substance waste and petroleum-contaminated waste are Class 1 unless you can show total petroleum hydrocarbons (TPH) at 1,500 parts per million (ppm) or less.

Any detectable TPH rules out Class 3.

Don't classify cleanup waste from a leaking underground storage tank (UST) under Subchapter R when 30 TAC Chapter 334 Subchapter K regulates it.

Can excavated soil in Texas be Class 3?

Excavation alone doesn't make soil Class 3.

Naturally occurring background constituents have a limited exception under 335.507(4)(B).

See Class 3 evidence, PCB rules and soil from outside Texas.
