Paint sludge
Paint solids have settled or separated into hazardous sludge.
Is California code 461 hazardous waste?
Not from the code alone. Waste must first be found hazardous. Code 461 isn't a restricted code, but a restricted category that fits takes priority over it. A code that isn't restricted doesn't make waste non-hazardous.
When a shipment needs the Uniform Hazardous Waste Manifest, enter 461 in Item 13 for the waste line. Use one California code, plus the federal RCRA codes when the waste is federally hazardous.
RCRA waste meets a federal listing or characteristic, with no federal exclusion that applies. Non-RCRA waste is hazardous under California rules only. California presumes hazardous waste is RCRA unless the generator shows it isn't, so keep that determination.
What does California code 461 cover?
This code is for hazardous solids that settled or separated out of paint handling as sludge. It leaves out paint that is still a liquid product, and unused organic paint discarded before use.

Is paint waste California code 461, 291 or 331?
| Code | When it fits |
|---|---|
| 461 | Paint handling produced settled or separated hazardous residue. |
| 291 | The discarded hazardous material is latex itself, rather than settled paint sludge. |
| 331 | Hazardous organic paint became waste before use because it was off-specification, aged or surplus. |
Paint collection routes don't take paint sludge. Find the waste's physical state and use history before picking a material code.
