291, Discarded latex material.
Organics
Discarded latex material
Latex itself is the hazardous waste, rather than paint sludge or polymerized resin.
Is California code 291 hazardous waste?
Not from the code alone. Waste must first be found hazardous. Code 291 isn't a restricted code, but a restricted category that fits takes priority over it. A code that isn't restricted doesn't make waste non-hazardous.
When a shipment needs the Uniform Hazardous Waste Manifest, enter 291 in Item 13 for the waste line. Use one California code, plus the federal RCRA codes when the waste is federally hazardous.
RCRA waste meets a federal listing or characteristic, with no federal exclusion that applies. Non-RCRA waste is hazardous under California rules only. California presumes hazardous waste is RCRA unless the generator shows it isn't, so keep that determination.
What does California code 291 cover?
This code is for latex when the latex itself is hazardous waste. It isn't for settled paint solids just because they came from latex paint, or for resin that has already polymerized.

Is latex waste California code 291?
| Code | When it fits |
|---|---|
| 291 | The discarded hazardous material is latex itself, rather than separated paint solids or cured resin. |
| 461 | Paint handling produced settled or separated hazardous sludge. |
| 272 | The hazardous waste is polymerized resin rather than latex material. |
Judge the discarded material by its composition and physical state. A container label or work area alone doesn't make it code 291.
