Hazardous sewage sludge
The sludge came from sewage treatment rather than another biological process.
Is California code 321 hazardous waste?
Not from the code alone. Waste must first be found hazardous. Code 321 isn't a restricted code, but a restricted category that fits takes priority over it. A code that isn't restricted doesn't make waste non-hazardous.
When a shipment needs the Uniform Hazardous Waste Manifest, enter 321 in Item 13 for the waste line. Use one California code, plus the federal RCRA codes when the waste is federally hazardous.
RCRA waste meets a federal listing or characteristic, with no federal exclusion that applies. Non-RCRA waste is hazardous under California rules only. California presumes hazardous waste is RCRA unless the generator shows it isn't, so keep that determination.
What does California code 321 cover?
This code is for hazardous sludge from sewage treatment. It depends on the source. Biological origin isn't enough, and sludge from another biological or industrial process isn't 321 because it looks similar.

Is biological sludge California code 321 or 322?
| Code | When it fits |
|---|---|
| 321 | The hazardous sludge was produced by sewage treatment. |
| 322 | A biological source produced the hazardous waste, but it is not sewage sludge. |
Keep the treatment-process record. The source separates sewage sludge from other biological waste, and hazardous status is decided on its own.
