D004, Arsenic.
Characteristic hazardous waste
Arsenic
Arsenic at 5 mg/L or more in the TCLP extract.

Is D004 hazardous waste?
Yes. Waste is D004 when the TCLP extract of a representative sample holds arsenic at or above 5 mg/L. That makes it toxic hazardous waste, whatever industry or process it came from.
Compare the arsenic in the TCLP extract with 5 mg/L. A total arsenic result is a different measure, so it can't be compared with this limit.
D004 is a nonacute characteristic. On a required hazardous waste manifest, put D004 in Item 13. See VSQG exemptions and empty-container rules.
What does D004 cover?
D004 applies when a representative sample gives a TCLP extract with arsenic at or above 5 mg/L. The limit is for the extract, not the waste’s total arsenic.

Is arsenic waste always D004?
| Code | When it fits |
|---|---|
| D004 | The TCLP extract of a representative sample holds arsenic at or above 5 mg/L. |
| D004–D043 | The arsenic result is below 5 mg/L, but another contaminant or characteristic can still apply. |
Generators decide the codes from testing or knowledge of the waste, under 40 CFR 262.11. A result below 5 mg/L rules out D004 only. It doesn't make the waste nonhazardous.
Which wastes take D004?
| Waste | When it’s D004 |
|---|---|
| Waste contaminated with toxic metals | Its arsenic leaches at the TCLP limit or above. |
| Arsenic-contaminated waste | Its arsenic leaches at the TCLP limit or above. |
| Contaminated soil | Its arsenic leaches at the TCLP limit or above. |
| Treated wood waste | Its arsenic leaches at the TCLP limit or above. |
| Used oil | Its arsenic leaches at the TCLP limit or above. |
| Waste batteries | Its arsenic leaches at the TCLP limit or above. |
| Waste pharmaceuticals | Its arsenic leaches at the TCLP limit or above. |
Which codes sit beside D004?
| Code | What it is |
|---|---|
| D001 | Ignitable waste |
| D002 | Corrosive waste |
| D003 | Reactive waste |
| D005 | Barium |
| D006 | Cadmium |
| D007 | Chromium |
| D008 | Lead |
| D009 | Mercury |
