D038, Pyridine.
Characteristic hazardous waste
Pyridine
Pyridine at 5 mg/L or more in the TCLP extract.
Is D038 hazardous waste?
Yes. D038 is hazardous waste when the TCLP extract of a representative sample holds pyridine at 5 mg/L or more. That makes it toxic hazardous waste, whatever industry or process it came from.
Compare the pyridine in the TCLP extract with 5 mg/L. A total pyridine result is a different measure, so it can't be compared with this limit.
D038 is a nonacute characteristic. On a required hazardous waste manifest, put D038 in Item 13. See VSQG exemptions and empty-container rules.
What does D038 cover?
D038 applies when the TCLP extract of a representative waste sample holds pyridine at 5 mg/L or more. The limit is for the extract, not the waste’s total pyridine. Under Table 1 footnote 3, the quantitation limit becomes the regulatory level when it is higher than the calculated level.

Is pyridine waste always D038?
| Code | When it fits |
|---|---|
| D038 | A representative sample’s TCLP extract contains pyridine at or above 5 mg/L. |
| D004–D043 | The pyridine result is below 5 mg/L. Another contaminant or characteristic may still apply. |
| U196 | Unused pyridine is discarded pure, technical grade, or as the product’s sole active ingredient. |
Generators decide the codes from testing or knowledge of the waste, under 40 CFR 262.11. A result below 5 mg/L rules out D038 only. It doesn't make the waste nonhazardous. Table 1 footnote 3 notes the quantitation-limit qualification for this entry.
Which wastes take D038?
| Waste | When it’s D038 |
|---|---|
| Contaminated soil | Pyridine leaching from contaminated soil reaches the TCLP limit |
Which codes sit beside D038?

| D035 | Methyl ethyl ketone |
| D036 | Nitrobenzene |
| D037 | Pentachlorophenol |
| D039 | Tetrachloroethylene |
| D040 | Trichloroethylene |
| D041 | 2,4,5-Trichlorophenol |
| D042 | 2,4,6-Trichlorophenol |
