D039, Tetrachloroethylene.
Characteristic hazardous waste
Tetrachloroethylene
Tetrachloroethylene at 0.7 mg/L or more in the TCLP extract.

Is D039 hazardous waste?
Yes. D039 is hazardous waste when the TCLP extract of a representative sample holds tetrachloroethylene at 0.7 mg/L or more. That makes it toxic hazardous waste, whatever industry or process it came from.
Compare the tetrachloroethylene in the TCLP extract with 0.7 mg/L. A total tetrachloroethylene result is a different measure, so it can't be compared with this limit.
D039 is a nonacute characteristic. On a required hazardous waste manifest, put D039 in Item 13. See VSQG exemptions and empty-container rules.
What does D039 cover?
D039 applies when the TCLP extract of a representative waste sample holds tetrachloroethylene at 0.7 mg/L or more. The limit is for the extract, not the waste’s total tetrachloroethylene.

Is tetrachloroethylene waste always D039?
| Code | When it fits |
|---|---|
| D039 | A representative sample’s TCLP extract contains tetrachloroethylene at or above 0.7 mg/L. |
| D004–D043 | The tetrachloroethylene result is below 0.7 mg/L. Another contaminant or characteristic may still apply. |
| U210 | Unused tetrachloroethylene is discarded pure, technical grade, or as the product’s sole active ingredient. |
Generators decide the codes from testing or knowledge of the waste, under 40 CFR 262.11. A result below 0.7 mg/L rules out D039 only. It doesn't make the waste nonhazardous.
Which wastes take D039?
| Waste | When it’s D039 |
|---|---|
| Contaminated soil | Tetrachloroethylene leaching from contaminated soil reaches the TCLP limit |
| Parts washer solvent | Tetrachloroethylene leaching from parts washer solvent reaches the TCLP limit |
| Solvent-contaminated wipes | Tetrachloroethylene leaching from solvent-contaminated wipes reaches the TCLP limit |
| Spent perchloroethylene dry-cleaning solvent | Tetrachloroethylene leaching from spent perchloroethylene dry-cleaning solvent reaches the TCLP limit |
| Dry-cleaning filter cartridges | Tetrachloroethylene leaching from dry-cleaning filter cartridges reaches the TCLP limit |
| Dry-cleaning distillation residue | Tetrachloroethylene leaching from dry-cleaning distillation residue reaches the TCLP limit |
| Unused perchloroethylene product | Tetrachloroethylene leaching from unused perchloroethylene product reaches the TCLP limit |
Which codes sit beside D039?
| Code | What it is |
|---|---|
| D035 | Methyl ethyl ketone |
| D036 | Nitrobenzene |
| D037 | Pentachlorophenol |
| D038 | Pyridine |
| D040 | Trichloroethylene |
| D041 | 2,4,5-Trichlorophenol |
| D042 | 2,4,6-Trichlorophenol |
| D043 | Vinyl chloride |
