How are Ontario waste codes identified?
Ontario uses a 3-digit class plus a primary characterization letter for subject waste.
Ontario’s commercial waste chemical definition takes a chemical product or manufacturing intermediate, an off-specification version, specified spill-cleanup material, and containers or liners that held these materials unless triple rinsed. Ordinary process waste doesn't fall in just because the named chemical contaminated it.
P and U classifications carry through to mixtures containing the listed waste and to derived waste. Schedule 2.1 applies to Part A and Schedule 2.2 to Part B. Derived waste may also have specific relief stated in its Environmental Compliance Approval. A general approval or treatment alone doesn't give that relief.
Clean Ontario debris has no hazardous waste number unless listed-waste contamination or a hazard characteristic makes it hazardous. Assess contaminated construction material by its actual constituents and the tests that apply.
The Registry has 2 fields. The waste number is the class plus primary letter, and the hazardous waste number is the Schedule identifier that applies. The latter is required for primary characterizations other than D, P or L. Land disposal restriction notices carry every identifier that applies, including those of incoming wastes mixed or bulked together.
How is Ontario hazardous waste collected and shipped?
Ontario uses its electronic Hazardous Waste Program Registry to register subject waste and issue manifests. Paper manifests need the Director's approval.
For subject waste, the generator registers the stream, enters the class-and-letter waste number in the manifest waste details and certifies before shipment. The carrier and receiver complete their own parts. An excluded stream gets no manifest duties just because it has a class number.
When is Ontario waste excluded or below the paperwork threshold?
| Place | Exclusions, thresholds and applicable routes |
|---|---|
| Ontario | Domestic waste is excluded from hazardous waste. The small-quantity exclusion covers listed industrial or chemical waste, and ignitable, corrosive, reactive or leachate-toxic waste, produced in a month or accumulated below 5 kg. For acute hazardous waste chemicals the limit is below 1 kg. It doesn't extend to PCB, severely toxic, radioactive or pathological waste. Liquid industrial waste has its own exclusion for quantities below 25 L, monthly or accumulated, and hazardous liquid waste can't use it. Use an approved carrier and a suitable receiver where required. The small-quantity exclusion removes HWP registration and manifest duties, not safe-management duties. A quantity exactly at the limit is outside these below-threshold exclusions. Don't split a larger quantity to claim them. s. 1 definitions; registration manual 2.2.4 A container is empty when you have removed the contents by normal pumping or pouring and left less than 2.5 cm on the bottom. Qualifying empty containers or liners from the specified ordinary hazardous categories are excluded. For acute hazardous chemicals the empty container must have a capacity below 20 L, or empty liners must total below 10 kg. Spill clean-up residues are excluded for spills below 5 kg of the specified ordinary categories, or below 1 kg of acute hazardous chemicals. These exclusions don't cover every hazardous category. s. 1 definitions (r)–(u) Intact batteries, common mercury waste, intact electronics and intact printed circuit boards sent to the matching recovery facility are not subject waste. Vehicle-servicing waste at a retail service facility is also excluded where an approved or registered waste system collects and manages it under a written agreement. Carrier and transfer-site relief for batteries and common mercury waste needs the receiver’s acceptance document with the prescribed information. The electronics route has its own conditions. Recycling alone doesn't exempt other wastes. s. 1(3)–(5) Qualifying construction, demolition, renovation or other defined field work away from the operator’s base, factory or warehouse can send waste to its qualifying local waste transfer facility without sections 18–26 registration or manifests at the field site. The operations must meet the ownership or written-agreement conditions, and the facility and transfers must meet sections 29.3–29.5. A remote site or a one-off job alone doesn't qualify. Onward shipments from the facility follow the usual subject-waste rules. ss. 29.1–29.5 Producing less than 100 kg a month is not a general manifest exemption. Section 80 allows the specified sealed-container land-disposal route only for qualifying industrial, chemical or characteristic waste produced at that facility, unmixed, with an intact compliant container and seal, a generator certificate, and a total container-and-contents weight of 250 kg or less. Also check the specific delistings in Schedules 1.1, 2.1 and 2.2, because a delisted stream can still meet a separate hazard characteristic. s. 80; Schedules 1.1, 2.1, 2.2 |
